<p><a href="https://www.Refundees.com/blog/ironclad-investments-ic-investments-nick-kafkoulas">Permalink</a><p>]]></content:encoded><media:content type="image/png" url="https://images.squarespace-cdn.com/content/v1/5fd9dc614ef85b79efa8cab3/1737980180429-NB59MGLESLPADXI9LQN6/blog+illustrations_top+3+latest+scams-35+%283%29.png?format=1500w" medium="image" isDefault="true" width="1102" height="922"><media:title type="plain">Ironclad Investments (IC Investments)</media:title></media:content></item><item><title>Did you invest through the ABLRate platform?</title><dc:creator>Stuart McFadden</dc:creator><pubDate>Thu, 27 Feb 2025 19:18:27 +0000</pubDate><link>https://www.Refundees.com/blog/ablrategettingyourmoneyback</link><guid isPermaLink="false">5fd9dc614ef85b79efa8cab3:5fd9f03fbbb72949cb6131f7:669e172871486a5be0e78505</guid><description><![CDATA[<h3><span><strong>The Facts</strong></span></h3><p class="">Matthew Haycox was disqualified from acting as a director for 12 years in October 2010.&nbsp; The Insolvency Service described his behaviour as ‘reckless’.</p><p class="">The Administrators Progress report for Huddle SPV 4 Ltd states that “<em>we understand that an individual may have been acting as a de facto or shadow director of [Huddle SPV 4 Ltd].... &nbsp; In addition, this individual (and entities owned by him and/or under his control appears to have been the beneficiary of significant loans from [Huddle SPV 4 Ltd].&nbsp; Many of these loans remain outstanding… &nbsp; We have recently presented a bankruptcy petition against this individual.</em>”&nbsp;</p><p class="">Mr Haycox was made bankrupt (for the second time) on 11-Feb-2025.&nbsp; The petitioners for the bankruptcy were the Administrators of Huddle SPV 4 Ltd.</p><p class="">Lowry Trading Ltd and Scott Fletcher have brought a commercial fraud claim against Mr Haycox reported to be for £5.6m.</p><p class="">The litigation funding firm Manolete Partners have brought a ‘breach of fiduciary duty’ claim to court against Mr Haycox together with other current and former directors of AIF 1 Ltd.</p><p class="">The ABLRate update to investors (in relation to Access Commercial Investors 1 Ltd and Access Property Finance Ltd) dated 25-Jan-2023 states that “<em>We had that call with the administrator representing DWF, a law firm that has appointed administrators over Access Commercial Investors 4 Ltd, and they feel that they might be seeking redress from the wider group</em>”.</p><p class="">The most recent Administrators Progress Report for Access Commercial Investors 4 Ltd states that “<em>Manolete are continuing to advance the claims assigned to them</em>.”&nbsp; Court listings now show Mr Haycox listed as a respondent in a case being brought by Manolete Partners against Access Commercial Investors 4 Plc.</p><p class="">The Administrators Proposals for Huddle Capital Group Ltd describe Mr Haycox as “<em>an intermediary and introductory broker for both the ABLRate Companies and Huddle Capital Group Ltd</em>.”</p><p class="">The most recent confirmation statement for Aviation and Tech Capital Ltd shows that Mr Haycox is the second largest shareholder in the company.</p><p class="">As at the Administration date, borrowers owed lenders of the ABLRate platform £21,484,607.&nbsp; The Administrators described the estimated outcome in respect of loan investors as “<em>currently unknown</em>”.</p><p class="">The ABLRate platform was regulated by the FCA.</p><h3><span><strong>What are some of the obligations of an FCA regulated entity?</strong></span></h3><p class="">A regulated firm is bound by rule 2.1.1 of the FCA’s Principles for Business Handbook (“PRIN”). This rule sets out the high level standards expected by all regulated firms and included in these rules are the following:</p><p class="">2. Skill, care and diligence - A firm must conduct its business with due skill, care and diligence.</p><p class="">6. Customers' interests - A firm must pay due regard to the interests of its customers and treat them fairly.</p><p class="">7. We’ve come to realise <strong>one key issue</strong>. Fraud data in the UK doesn’t reflect the reality that victims face.</p>
<p>This is due to a combination of different factors, and there isn’t a silver bullet for fixing the data problem. Like a lot of things in the Financial Crime world, it’s complex. But a new approach may be needed to incentivise victims to <strong>Report Fraud</strong>. </p>
<p>There are <strong>two</strong> starting places, however, to look at when considering fraud data. Looking at each of these sources will never tell the whole picture. We’ve tried to explain why below. </p>
<h2>Action Fraud</h2>
<p>Action Fraud is the UK’s national reporting centre for fraud and cybercrime, run by the City of London Police. When someone has been the victim of fraud, it is always sensible to ensure that the crime is reported through the website. Action Fraud works on a triage system, so the more people who report a type of crime, or a specific entity, the more likely law enforcement are to follow up. </p>
<p>But Action Fraud has well recognised issues, with some now referring to it as <em>Inaction Fraud</em>. Common criticisms are that the reporting system is difficult to navigate, which isn’t great for vulnerable fraud victims. And there’s little-to-no follow up after a crime is reported. <strong>It appears to drop into a black hole of nothingness</strong>. Finally, whilst many financial institutions do tell people to report to Action Fraud, it’s not a requirement in many cases, meaning that if someone does successfully recover money through their bank, or just gives up, there’s no reason to report the fraud. It therefore <strong>never appears in the data</strong>. </p>
<h2>UK Finance</h2>
<p>UK Finance is the Financial Services industry lobbying group. They represent banks and other financial institutions around the UK. They produce an annual, (and half-yearly), fraud report, where they describe the volumes of fraud they’ve seen through the last year. That sounds great, right? </p>
<p>However, banks’ incentives aren’t directly aligned with fraud victims, and banks don’t report fraud data just because a customer reports fraud. They will only report <strong>some types</strong> of fraud, and a notable exception is when losses are not <em>technically</em> directly from the banks’ accounts, for example, crypto transfer fraud, where a victim pays into their own wallet first, before moving money to a fraudster. </p>
<p>UK Finance <strong>only represents its members</strong>, and there are some notable exceptions. For example, Revolut is not a member, (as of writing at least), but is a large cause of complaints for fraud to the Financial Ombudsman Service. <strong>As they’re not a member</strong>, no fraud through Revolut is included in their data. </p>
<p>Finally, banks will report what <em>they are happy</em> to categorise as fraud. Due to new Payment Systems Regulator (PSR) regulations, it’s possible for a bank to become liable for the losses a customer incurs. As a result, we regularly see banks categorising fraud as ‘civil disputes’ or ‘failed investments’ in order to avoid incurring liability. Based on our assessment, we believe that the majority of affected people will be eligible for reimbursement through their banks</p><p data-rte-preserve-empty="true" class=""></p><p class=""><span><strong>What happened?</strong></span></p><p class="">Cask Whisky Ltd sold Whisky casks directly to investors who were promised returns on their aged whisky.</p><p class="">Cask Whisky Ltd entered liquidation in July 2024 surprising investors and is currently being investigated for fraudulent activity by City of London Police.<br></p><p class=""><span><strong>If you paid via Credit Card</strong></span></p><p class="">If you paid by credit card, you should have protection under Section 75 of the Consumer Credit Act 1974. This covers you as long as you paid £100 via credit card but it only covers you up to £30,000. If you paid a deposit via credit card and the rest via another method, you can still claim up to £30,000.&nbsp;</p><p class="">In simple terms, the protection applies if there is a breach of contract or misrepresentation by the retailer (in this case Cask Whisky Limited). Investors were told that Citygate had relationships with a number of local councils in the UK. These councils apparently needed properties for social housing, for which they were willing to pay above average rent. Tenants would be placed into the housing units, and the councils would pay Citygate above average returns. Citygate would enable this arrangement with the councils and the landlords, and therefore would take a management fee. The capital would be provided by investors who would also receive above average returns for putting their capital at risk.&nbsp;</p><p class="">We understand that some of the original Directors recently resigned, and there are now issues with investors and landlords receiving their monthly payments. Novus Black appointed MCI Global Investment Advisors Ltd (‘MCI’), who are regulated by the FCA, to carry out this function.</p><p class="">While the funds were responsible for raising capital from investors and investing it, MCI was responsible for implementing appropriate risk management, compliance and governance policies and procedures.  Any traders engaged by the funds would also have been required to be personally authorised by the FCA.</p><p class="">It appears that use of unauthorised traders by the funds may have resulted in significant losses for investors, losses which in turn were not reported by MCI in the way that they should have been.</p><p class=""><span><strong>Insolvency Service press releases</strong></span></p><p class="">There are two press releases from the Insolvency Service that those who have lost money in the funds may find interesting to read.</p><p class="">The first concerns Desmond Amey, a former director of Novus Black Ltd: '<a href="https://www.gov.uk/government/news/cryptocurrency-advice-firm-shut-down-after-investors-lost-money-and-director-failed-to-keep-proper-accounts" target="_blank">Cryptocurrency advice firm shut down after investors lost money and director failed to keep proper accounts</a>' relates to the closure by the Insolvency Service of Desmond Amey's company, Amey Finance Academy Ltd.&nbsp; Mark George, Chief Investigator at the Insolvency Service, said: that "<em>Desmond Amey used Amey Finance Academy to recklessly persuade individuals to invest in cryptocurrency schemes and mislead them about the risks of doing so</em>".&nbsp; Amey was a director of <a href="https://find-and-update.company-information.service.gov.uk/company/13531968" target="_blank">Novus Black Ltd</a>&nbsp;for two separate periods between 1st February 2022 and 18th August 2022.</p><p class="">The second concerns Suzanne Harley-Davies, who appears to be Novus Black's legal counsel: '<a href="https://www.gov.uk/government/news/companies-promoting-corporate-rescue-scheme-shut-down-after-undermining-insolvency-regime" target="_blank">Companies promoting ‘corporate rescue’ scheme shut down after undermining insolvency regime</a>' makes reference to Suzanne Harley-Davies in her role of director of <a href="https://find-and-update.company-information.service.gov.uk/company/14953589" target="_blank">Namare GRP Ltd</a> and <a href="https://find-and-update.company-information.service.gov.uk/company/14454195" target="_blank">TPG GRP Ltd</a>.&nbsp; These companies appear to be involved in actions which Mark George, Chief Investigator at the Insolvency Service, said "<em>would appear to have deliberately undermined the insolvency regime which is why the Secretary of State applied to have them and their associated companies wound-up in the public interest"</em>.&nbsp; Ms Harley-Davies describes herself as a legal counsel and a solicitor.&nbsp; However, we have been unable to locate her on the <a href="https://www.sra.org.uk/consumers/register/" target="_blank">Solicitors Regulation Authority register</a> which is '<em>the definitive impartial source of information about the law firms and people regulated by the Solicitors Regulation Authority</em>'.</p><h3><strong>Can Refundees get my money back through the FSCS?</strong></h3><p class="">On 23 October 2024, MCI Global Investments Advisors Limited entered into Creditors Voluntary Liquidation (<a href="https://www.fca.org.uk/news/news-stories/mci-global-investment-advisors-limited-enters-liquidation" target="_blank">MCI Global Investment Advisors Limited enters liquidation | FCA</a>). &nbsp;Investigations are ongoing by the FCA who are liaising&nbsp;closely with the&nbsp;appointed liquidator.</p><p class="">While we await the outcome of these investigations, we think it is likely that MCI may have failed in one or more of its overall governance obligations.</p><p class="">If this is the case, then investors in the funds may be eligible to make a claim under the Financial Services Compensation Scheme (FSCS) against MCI up to a maximum of £85,000 per person.</p><p class="">Refundees would like to assist investors in the funds with exploring these FSCS claims.</p><h3><strong>How would the process work?&nbsp;</strong></h3><p class="">Using Refundees, we manage everything for you. PSPs include UK banks or Electronic Money Institutions (EMIs) such as Revolut or Wise. For simplicity, throughout this article we are going to refer simply to “banks” but really we are talking about all PSPs.&nbsp;</p><p class="">As it stands, you will be covered for up to £85k per scam claim. You are only covered if the payment was a UK to UK bank transfer and it was made on or after 7 October 2024. If you do not meet this criteria, there are other options for reimbursement that we discuss further down.&nbsp;</p><h3><strong>Does Mandatory Reimbursement mean banks will refund scammed money?&nbsp;</strong></h3><p class="">In short answer, victims stand a better chance of recovering money, but this is not guaranteed. </p><p class="">Even if you are covered, the bank may still refuse to reimburse you under certain circumstances (more on this further down) and this can be challenged too.&nbsp;</p><h3><strong>What PSPs are covered by Mandatory Reimbursement?</strong></h3><p class="">It covers all Payment Service Providers (over 900), which include HSBC, Lloyds, Barclays, Santander, Revolut, Wise, etc. Your payments are covered if you made a payment over the Faster Payment network, which is a common but specific type of bank transfer. If you are a business, some additional criteria apply.&nbsp;</p><h3><strong>How much you are covered for?</strong></h3><p class="">You are covered up to £85k of losses per scam claim, per bank you sent the money from. For example, if you sent £85k from your Lloyds account and £85k from your Barclays account to the same scam, you’d be covered for £170k. If you sent all the money from the same bank, you’d only get £85k. A “scam claim” is a sequence of payments made as part of the same scam. </p><p class="">Very importantly, if you lost more than £85k, you do have other options which we’ve set out at the end of this article. Your bank or the bank you sent the money to may still have failed in other obligations to stop fraud and you can fight them on that.&nbsp; You can use Refundees to do this for you.&nbsp;</p><p class="">Banks are also allowed to charge a £100 excess. It is optional whether they charge this but if they do, it effectively means that you are not covered for the first £100 of any loss.&nbsp;</p><h3><strong>Why can a bank refuse a refund under PSR Mandatory Reimbursement?</strong></h3><p class="">Banks have a history of failing to reimburse scam victims when they should have as it can cost them a lot of money. If a bank tells you that you are not covered or that you aren’t going to be reimbursed, you shouldn’t necessarily take that at face value. After a scam, people often feel low on confidence or feel it’s their own fault. Don’t let them take advantage of that. </p><p class="">There are a number of reasons they will try to say no to you. There are some valid reasons where they can refuse reimbursement, but the banks will often refuse reimbursement unfairly. Even in these cases, Refundees is successful against banks, which shows there is still a huge problem with banks failing to reimburse people when they should have. </p><p class="">Below are the reasons why they might say ‘no’ to you.&nbsp;</p><h4><em>It’s a civil matter and not a scam</em></h4><p class="">The PSR mandatory reimbursement rules, like other fraud protection, only cover scams and not civil disputes. Because it only applies to scams, banks have historically and unfairly refused to reimburse people by telling them that what has happened to them is in fact <em>not a scam</em> or that there isn’t enough evidence. We’ve seen them say this even in extreme cases where the evidence is overwhelming.&nbsp;</p><p class="">If you know something is fraud, you shouldn’t let the banks refuse reimbursement with this excuse.&nbsp;</p><h4><span><em>You did not meet the “standard of caution” expected and acted with gross negligence</em></span></h4><p class="">This is where we expect that most people will be unfairly denied reimbursement. </p><p class="">The below are four ways the bank can refuse to give you a scam refund under the PSR Mandatory Reimbursement rules.</p><p class=""><strong>1. You did not have regard to warnings</strong></p><p class="">If you did not have regard to interventions made by the bank or the police where they warned you very clearly that this was a scam, you may be denied a refund for the money you lost in the scam. But just because the bank or the police spoke to you, does not mean that you can automatically be denied a refund.</p><p class="">The warning needs to be so significant that you acted with a “significant degree of carelessness” in ignoring it. We expect that banks and particularly EMIs will continue to use generic, ineffective, and automated in-app warning screens to deny reimbursement. The new regulation makes it clear that these are unlikely to be sufficient to deny reimbursement. The banks know that these warnings and interventions often have little chance of exposing and preventing a potential APP scam. If you have been denied a scam refund under this PSR Mandatory Reimbursement rule, you can challenge it.&nbsp;</p><p class=""><strong>2. You did not report the fraud to the bank within a reasonable time</strong></p><p class="">Generally it’s expected that you report the scam within 13 months of the last payment you made. If you didn’t report it within this time, then you simply need a reasonable explanation why you didn't. For example, it could have been a long running scam that went on for many years so you only found out recently.&nbsp;</p><p class=""><strong>3. You need to respond to reasonable and proportionate information requests from the bank when you report the fraud</strong></p><p class="">It’s understandable that a bank would like to find out more about what happened and to seek out evidence that you’ve been the victim of a scam. If you didn’t engage with reasonable information requests, you can be refused reimbursement.&nbsp;</p><p class=""><strong>4. You need to consent to the scam being reported to the police</strong></p><p class="">When you make a claim, you need to have either reported it to the police or consent to the bank reporting it unless there is a very good reason you don’t want them to. You can find details on <a href="https://www.actionfraud.police.uk/reporting-fraud-and-cyber-crime"><span><em>how to report it to Action Fraud here</em></span></a>.&nbsp;&nbsp;</p><p data-rte-preserve-empty="true" class=""></p><p class="">If you’ve been denied for any of the above reasons, you should be prepared to challenge it. </p><h4><strong>Vulnerability and mandatory reimbursement</strong></h4><p class="">If you can demonstrate that you were vulnerable at the time the scam took place, you should be reimbursed regardless of any reason the bank tries to say no to you. The regulation defines vulnerability as:</p><p class=""><em>“Someone who, due to their personal circumstances, is especially susceptible to harm – particularly when a firm is not acting with appropriate levels of care</em>.”</p><p class="">You will therefore need to provide evidence of your vulnerability at the time.</p><p class="">This is a really important part of the PSR Mandatory Reimbursement rules as scam victims who are vulnerable cannot be denied a scam refund on the above four grounds.&nbsp;</p><p class="">When you fall victim to a scam, there are often temporary or permanent circumstances that contributed to the scam. For example, we often see people lose money to investment scams after inheriting money due to a parent passing away. The impact of the bereavement often left them vulnerable during the period they invested, and could mean they are more likely to receive a refund under the new PSR rules.</p><p class=""><strong>What if you lost more than £85k?</strong></p><p class="">If you sent the money from more than one bank or EMI you have an £85k limit for each of those institutions. </p><p class="">However, if you’ve sent more than £85k from one, you still do have options to try and seek reimbursement. The same options apply as those who are not covered by the mandatory reimbursement rules at all (below).</p><p class=""><strong>What if you are not covered by PSR Mandatory Reimbursement Rules? (You paid the scammers via a different method or paid before 7 October 2024?)</strong></p><p class="">The rules are not retrospective so do not apply to payments before 7 October 2024. It was discovered that the total loss to investors when the company folded was roughly £2.8 million.</p><p class="">As a result, Campbell was banned by The Court of Session in Edinburgh from being a company director for 14 years in August 2023, but unfortunately investors are still left with a huge loss.</p><h3><strong>How do you get your money back?</strong></h3><p class=""><strong><em>If you paid via UK bank transfer:</em></strong>&nbsp;</p><p class="">In short, if you sent the money via UK bank transfer from a bank that is signed up to the Contingent Reimbursement Model Code (CRM), you could get your money back.   <h3><strong>What happened?</strong></h3><p class="">ACH Investments offered a rent-to-rent investment scheme, finding properties to rent from landlords, refurbishing them, and renting out to housing associations/Shelter charities for asylum seekers and other vulnerable people. Deals were sold to investors in which properties were rented from the landlord on a long-term company let contract, and then renting the properties back to a housing association for a monthly rental, the difference being the profit paid to investors.
